Nintendo wins legal battle against file-sharing service over the removal of pirated games

Nintendo has successfully won its lawsuit against Dstorage, the French file-sharing company that owns 1fichier.com, after accusing it of facilitating piracy by failing to remove illegal game uploads.

The details:

  • Back in 2021, a Paris court ruled that Dstorage was responsible for failing to remove illegal copies of games from 1fichier and ordered it to pay Nintendo €935,000 in damages. However, the company filed an appeal, which ultimately failed in 2023, resulting in additional costs.

  • Following its unsuccessful appeal, Dstorage took the case to France's highest court, arguing that a court order would be required to remove the illegal content, effectively absolving it of any wrongdoing. Unfortunately for the company, the court has once again ruled in favor of Nintendo, bringing an end to the lengthy battle.

  • Dstorage must now remove all illegal content whenever requested in the future, with Nintendo's victory sending a message to all other European file-sharing sites that they, too, risk being targeted if they fail to combat illegal uploads. Nintendo stated that it was "pleased" with the ruling and that it is "significant not only for Nintendo, but for the entire games industry."

  • Nintendo has had a busy few years in terms of lawsuits, with the company ordering the shutdown of the Yuzu and Ryujinx Switch emulators, and the developer of the former ordered to pay over $2.4 million in damages. Last November, the company sued a pirate who had played illegal Switch games on multiple livestreams, and also filed two more lawsuits against pirates in mid-2024.
