Genki, a company that makes accessories for several popular game consoles, has been ordered to pay an undisclosed amount to Nintendo for damages caused by its Switch 2 mockup, which was displayed at CES prior to the system's official reveal.

The details:

  • Prior to the Switch 2's reveal, Genki appeared at CES 2025 with a replica model of the console, which it initially claimed was based on the real system it had gained early access to. The company later clarified that it had not seen the console and created the dummy model based on leaks, though the mockup later turned out to be extremely accurate.
  • Nintendo then filed a lawsuit against Genki in May, accusing the manufacturer of "embarking upon a strategic campaign intended to capitalize on the public interest surrounding Nintendo's next-generation console." The Japanese gaming giant claimed that Genki had "boasted its alleged early access to the unreleased console and allowed guests to hold and measure the mockups," and that its claims of compatibility with the then yet-to-be-revealed system could only be verified by gaining "unauthorized, illegal early access."
  • Fast forward four months, and a recent court document discovered by @OatmealDome shows that both parties have settled the lawsuit. The document confirms that Genki will pay Nintendo an undisclosed amount in damages and that a permanent injunction prohibits it from using any Nintendo branding or designs, as well as terms like "Genki Direct" and "Glitch," since they are tooย similar to Nintendo's trademarks.
  • Despite the initial claims made by a representative at the company's CES booth, the document states that Genki has continued to deny having accessed or acquired a Switch 2 console prior to its launch.
