Discord says it hasn't been served with Take-Two's GTA 6 subpoena and will evaluate it when it is

The details:

• Discord's marketing director Ryan Rigney wrote on X on August 24 that "Discord has not yet been served with a subpoena from Take Two. When we do, we'll evaluate the validity and scope before responding." The court granted Take-Two's subpoena requests on August 21, one day after they were filed, and set a September 4 deadline for both Discord and Microsoft to produce records.
• The breadth of the request is what has alarmed users. Take-Two is seeking registration emails, IP addresses, phone numbers, linked account information, and device identifiers for all users who were members of servers including discord.gg/odyssey and discord.gg/darkviperau during a specified period. Those servers are not run by the alleged leaker, meaning the data dragnet could sweep in thousands of uninvolved people.
• Microsoft has already signalled its willingness to comply. Xbox CTO Scott Van Vliet wrote on X that the company is "working closely with Take-Two and Rockstar Games to support efforts to protect creative works and intellectual property." Discord, as a communications platform with a stated commitment to user privacy, is in a different position.
• Discord has a track record of scrutinising overly broad legal demands. In a 2024 dispute with publisher Nexon, one of the company's lawyers wrote: "Discord is committed to fulfilling its obligations under the law, but acting as your copyright assertion partner is not one of them." Whether it takes a similar stance here remains to be seen.
• The leaks themselves continue to escalate. The group behind them recently encouraged fans to show up at Rockstar North's Edinburgh office, and at least one person did. The GTA 6 leaker is also running what is widely considered a crypto scam alongside the footage drops, watermarking clips with promotion for a meme coin.
